Before I knew too much about Girl Talk I would have said yes his work was illegal. But after watching RiP! (my introduction to Girl Talk), I’m not so sure anymore. I’m leaning towards it being legal. I was amazed by how persuasive the film was.

Well what makes this a potentially sticky issue is the idea of fair use & transformation.

Clarification: Girl Talk performances are legal, it’s the releasing of CDs or downloads without rights clearance that’s not legal (regardless of if one charges or gives it away for free).

It looks like this documentary is raising all of the right questions, and hopefully with the added popularity of artists like Greg (Girl Talk), those questions will finally be resolved. DJ Z-Trip has been releasing music in a similar style for over a decade and there have been always been debates about it’s legality.
