Man, I was on MUNI once and a really obnoxious 16-20 yr old sat behind me, I can’t remember what he was doing, but basically daring me to turn around and confront him and his asshole follower boys. Then, when the bus stopped, he leaned forward, YELLED as loud as he could directly into my ear, and jumped out the door. If I had better reflexes and were the type, it would have justifiable to react to his assault by punching him in the face like swatting a fly from your ear. Instead, I stewed and fantasized for awhile about beating him with a baseball bat. Same route, one other time some dickhead kid thinking he’s cute pulled the electrical cables off, and for whatever reason the driver couldn’t put them back (didn’t even try) and an entire busload had to wait 20 minutes for the next bus. This state of affairs leads one to believe in vigilante justice. Or that perhaps adolescence may deserve the occasional use of tasers. No, no, only a small percentage of adolescents need electroshock treatment.

The elements of a defamation claim are:

1. publication of a statement of fact
2. that is false,*
3. unprivileged,
4. has a natural tendency to injure or which causes “special damage,” and
5. the defendant’s fault in publishing the statement amounted to at least negligence.

Just remember what it means to call someone who has not been convicted of a crime a criminal in a public space.

There’s a similar “hire a (not) cop” down on Cesar Chavez and Mission at night. While I cannot confirm – he didn’t really seem upstanding enough to be an off duty cop or maybe itwas just because I don’t remember him having a gun.

Couple of fundamental differences here for starters Elle is not racist or racially insensitive and her work is more thought provoking than Katie’s. It also takes more skill, planning and insight.

Elle has awesome rationalizations. She steals yogurt from Whole Foods to give to people with no teeth. She disputes that she’s tagging, because she’s not tagging, she’s writing. She steals a Burberry coat because… um… I’m sure if you asked her it would be something awesome.

What I’m saying is that she’s way more fun than another boring racist.
